You must be at least 18 years of age to use NGUYENER. By using our service, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts that we believe belong to minors.

NGUYENER is an AI-powered personal styling service. We provide fashion recommendations based on information you share with us, including your occasion, measurements, color season, budget, and style preferences.

Our styling recommendations are generated by artificial intelligence. While we strive to provide useful, personalized advice, recommendations are suggestions only — not guarantees of outcome, fit, or satisfaction. Fashion is subjective, and your individual results may vary.

NGUYENER uses machine learning models — not large language models (LLMs) or generative AI — to power its styling recommendations. Specifically:

• Recommendations: We use an embedding-based similarity search (sentence-transformers) combined with vector similarity (pgvector) to match you with products that align with your style preferences, body type, and color season. Your swipe history trains the algorithm to improve future recommendations.
• Clothing analysis: On-device computer vision models analyze clothing in photos you upload. This processing happens locally on your device — your images are not sent to external AI services for analysis.

You acknowledge that:

• Recommendations are generated by machine learning algorithms and may occasionally be inaccurate, outdated, or unsuitable for your specific needs
• The system does not have physical awareness of you and relies entirely on information you provide
• No automated styling service replaces the judgment of a professional human stylist for high-stakes occasions
• Product availability, sizing, and pricing are subject to change and we make no warranties regarding third-party retailers

NGUYENER offers a free tier with limited daily consultations and a paid tier (“Pro”) with expanded access. The specific limits and pricing for each tier are displayed on our pricing page and are subject to change with reasonable notice. We reserve the right to modify, suspend, or discontinue the free tier at any time.

The NGUYENER Pro subscription is a recurring subscription that automatically renews at the end of each billing period (monthly or annually, depending on the plan you selected) until you cancel. By subscribing to Pro, you authorize NGUYENER to charge your payment method on file at the then-current subscription rate at the start of each renewal period.

Price changes: We may adjust subscription pricing from time to time. If we increase the price of your subscription, we will notify you at least 30 days before the change takes effect. Your continued subscription after the effective date constitutes acceptance of the new price. If you do not agree to the price change, you may cancel before the new price applies.

Payment processing: All payments are processed securely by Stripe. NGUYENER does not store your payment card details on its own servers. Failed payment attempts may result in temporary suspension of Pro features until the payment issue is resolved.

Refunds: Subscription fees are generally non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at [email protected] within 30 days of the charge, and we will review your request.

You may cancel your Pro subscription at any time through your account settings on nguyener.app. No phone call, email, or written notice is required to cancel.

Effect of cancellation: When you cancel, your Pro subscription will remain active until the end of your current paid billing period. You will not be charged for subsequent periods. After your subscription expires, your account will revert to the free tier, and you will retain access to your saved items, style profile, and consultation history.

Re-subscribing: You may re-subscribe to Pro at any time through your account settings. Your style profile and saved data will be preserved regardless of your subscription status.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.

You may not share your account with others or use our service to create multiple accounts for the purpose of circumventing usage limits.

When you upload photos or other content to NGUYENER, you grant us a limited, non-exclusive license to process, store, and analyze that content solely for the purpose of providing styling recommendations to you. This license terminates when you delete the content or close your account.

You represent and warrant that: (a) you have the right to upload the content; (b) the content does not violate any third-party rights; and (c) the content does not contain illegal material.

We do not use your photos or personal information to train AI models without your explicit consent.

Product recommendations may include affiliate links. We earn a commission when you make a purchase through such links at no additional cost to you. These commercial relationships do not influence the styling advice we provide. All affiliate relationships are disclosed in our Privacy Policy.

You agree not to use NGUYENER to:

• Violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or circumvent our systems
• Upload content that is illegal, harmful, or violates others’ rights
• Impersonate any person or entity
• Interfere with the service or other users’ access to it
• Use automated tools to access the service in excess of normal usage patterns

Violation of these terms may result in immediate termination of your account.

Platform content: NGUYENER and its content, features, functionality, branding, design, and underlying technology (including machine learning models, algorithms, and software) are owned by NGUYENER LLC and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret law. You may not reproduce, distribute, reverse-engineer, or create derivative works from our service without express written permission.

Your content: You retain full ownership of any content you upload to NGUYENER, including photos, style preferences, and profile information. By uploading content, you grant NGUYENER LLC a limited, non-exclusive, royalty-free, revocable license to use, process, and store that content solely for the purpose of providing and improving the styling service for you. This license terminates when you delete the content or close your account.

AI-generated recommendations: Styling recommendations generated by our algorithms are provided for your personal use. We do not claim ownership of the specific recommendations we generate for you, but you may not resell, sublicense, or commercially redistribute them. The underlying algorithms, models, and data structures used to generate recommendations remain the exclusive property of NGUYENER LLC.

Product images and third-party content: Product images, descriptions, and pricing displayed in our recommendations are sourced from third-party retailers and are the intellectual property of their respective owners. NGUYENER displays this content under license from retail partners and authorized APIs. You may not download, scrape, or redistribute third-party product content from our service.

Feedback: If you provide suggestions, ideas, or other feedback about our service, you grant NGUYENER LLC an unrestricted, irrevocable, royalty-free license to use that feedback for any purpose, including improving our products and services, without obligation to you.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Fashion recommendations are opinions generated by AI. We make no warranties regarding the accuracy, completeness, suitability, or quality of any recommendation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NGUYENER LLC, ITS MEMBERS, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, NGUYENER LLC SHALL NOT BE LIABLE FOR: (A) THE ACCURACY, FIT, QUALITY, OR SUITABILITY OF ANY FASHION RECOMMENDATION OR STYLING SUGGESTION; (B) ANY PURCHASE DECISION YOU MAKE BASED ON OUR RECOMMENDATIONS; (C) THE AVAILABILITY, PRICING, QUALITY, OR CONDITION OF THIRD-PARTY PRODUCTS LINKED FROM OUR SERVICE; (D) ANY DISSATISFACTION WITH PRODUCTS PURCHASED THROUGH AFFILIATE OR RETAILER LINKS; OR (E) ANY ALLERGIC REACTIONS, SKIN IRRITATION, OR PHYSICAL DISCOMFORT RESULTING FROM CLOTHING OR ACCESSORIES RECOMMENDED BY OUR SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NGUYENER IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

You agree to indemnify and hold harmless NGUYENER LLC, its members, and its operators from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your violation of these Terms; (b) content you upload; or (c) your violation of any third-party rights.

Either party may terminate this agreement at any time. You may close your account through your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination, your right to use the service ceases. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
